Soda Sand Surf Escapes Terms and Conditions

Soda Sand Surf Escapes provides its services to you subject to these terms and conditions. 

As a participant in our surf escape tour, it is crucial that you carefully read and fully comprehend the information outlined in these Terms and Conditions. We at Soda Sand are thrilled to have you on board and look forward to providing you with exceptional services. Please note that these terms and conditions form the basis of your tour experience and cannot be altered. This agreement is wholly in writing. Any amendments or waivers made by an employee, agent, representative of Soda Sand, or any other supplier, will not be valid. Additionally, these terms and conditions must be read in conjunction with the Booking Policy Terms and Conditions, both of which will govern your participation in the tour.

Parties 

These terms and conditions (including the exclusion of liability) bind you (the person specified in making the booking). References in these terms and conditions to Soda Sand include (where the context permits) our employees, agents, contractors, and suppliers, and these terms and conditions (including exclusions from liability) apply to their benefit. 

Acknowledgments

Traveling with Soda Sand requires a level of adaptability, a positive attitude, and an understanding that tour plans, including modes of transportation, accommodation, and itineraries, may be subject to change without prior notice due to circumstances beyond our control, such as flight delays, cancellations, or postponements due to inclement weather in Indonesia, or other unpredictable events like landslides, road blockages, floods, political unrest, or delayed arrival. In such situations, we reserve the right to modify, alter, reroute, or cancel our tours, and we cannot guarantee precise arrival or departure times for certain aspects of the tour.

To ensure a smooth and enjoyable experience, we ask that you comply with our guidelines and advice during the tour, as well as all laws and legal requirements (including visa) of Indonesia while participating in the tour. You acknowledge that participating in the tour involves group interaction with other participants and Soda Sand tour leaders and agree to act in a respectful and courteous manner towards them. Any disruptive or harmful behavior towards other participants, Soda Sand personnel, or the general public will not be tolerated and may result in the termination of your tour participation. Additionally, we request that you treat the environment with respect and caution.

In the event of any violation of these terms and conditions, or if there are reasonable grounds for us to do so, we reserve the right to cancel your participation in the tour without any liability. Any participation in illegal activities or deliberately negligent, violent, or dangerous behavior during the tour may also result in the cancellation of your participation.

Guest’s responsibilities

You must be physically fit and capable of swimming for the tour. Studying the itinerary and pre-departure information to bring appropriate clothing, equipment, and personal documentation is essential. You must assess your comfort level in participating in optional activities. You are responsible for your own belongings and the company is not liable for any loss, misplacement, or theft of personal items.

Medical requirements 

You must be in adequate health and inform Soda Sand of any known medical conditions. You must bring the necessary medication and obtain adequate travel and medical insurance. Health advice and precautions, including vaccination and malaria, should be consulted with a healthcare advisor. Soda Sand is not liable for any illness or injury sustained during the tour. Participants must be medically capable of completing the tour and authorise Soda Sand to arrange medical services at their cost in case of illness or injury. You acknowledge that tours are carried out in areas with limited medical services. You hereby authorise Soda Sand to take such action as is necessary (but without any obligation on Soda Sand to do so) for the provision of medical services at your cost including but not limited to, the arrangement of any medical evacuation service by air, road or sea, the attendance of any nurse, doctor, paramedic or ambulance officer and any necessary hospital service. You must pay on time the costs of those services to the provider of those services. You are not entitled to any refund for any part of a tour that you missed due to sickness, illness, or injury or due to other circumstances outside the control of Soda Sand.

Covid-19

If you are experiencing any symptoms of COVID-19, have been in contact with someone who has tested positive, or have traveled to a high-risk area, we ask that you inform us immediately and refrain from commencing your purchased tour until you have completed a period of self-isolation or obtained a negative test result.

Soda Sand Surf Escapes is not liable for any illness, injury, or loss caused by COVID-19 during your participation in or before our trips and activities.

By agreeing to these terms and conditions, you acknowledge and accept the risks associated with COVID-19 and release and hold harmless Soda Sand, its owners, agents, and other guests from any liability related to COVID-19.

Travel Insurance Requirements 

Participants must have adequate travel insurance that covers death, personal accident, medical expenses, air ambulance, air rescue, loss of effects, repatriation costs, and any other expenses resulting from death, loss, damage, injury, delay, or inconvenience. The insurance must be purchased before departure for your trip. The insurance must cover "adventure activities", "water-based activities" and “Covid-19 related incidents”. Participants must inform the insurer of the type of travel being undertaken. 

As a guest of Soda Sand Surf Escapes, it is your responsibility to arrange timely arrival for the start of the trip. Although we understand that flight-related issues may arise, we are not liable for any inconvenience or financial loss caused by delayed or missed flights.

In the event of a delayed or missed flight, you will not be eligible for a refund and any additional expenses incurred will be your responsibility. Please plan accordingly and make all necessary arrangements to ensure prompt arrival.

Liability

You release Soda Sand from all claims and liabilities arising from your participation in the tour, including, but not limited to, actions (or inactions) taken by Soda Sand or third parties such as suppliers or other participants. This includes any allegations, causes of action, demands, proceedings, litigations, investigations, judgments, losses, costs, or expenses, whether present or future, fixed or unascertained, actual or contingent, arising at law or in equity, or under any statute. You agree to indemnify Soda Sand for any loss suffered by it and against all claims and liabilities that result from your participation in the tour or any breach of these terms by you.

Soda Sand may suspend its obligations under these terms and conditions if events outside of its control prevent it from performing, such as natural disasters, fires, earthquakes, explosions, government directives, labor disputes, acts of God (e.g. floods), terrorism, or any other cause beyond our reasonable control. Unless required by law or otherwise agreed in writing by Soda Sand, no refunds will be provided and no claims can be made if you do not complete the tour, for any reason.

You acknowledge that you will not be able to claim compensation or seek damages if Soda Sand exercises any of the rights granted to it under these terms and conditions unless otherwise stated in these terms and conditions.

Soda Sand Disclaimer 

We at Soda Sand take pride in working with trusted and professional suppliers to provide our guests with a smooth and enjoyable travel experience. However, as we act only as an intermediary between guests and these suppliers, we cannot be held responsible for their services. Any disputes or issues that may arise should be addressed directly with the supplier and resolved through their jurisdiction of the business. It is important to note that clients are responsible for arranging their own international air travel and obtaining adequate travel insurance and trip cancellation coverage to protect against unforeseen circumstances.

By agreeing to this disclaimer, you acknowledge and accept the terms and conditions outlined herein

Publicity

By participating in the Soda Sand trip, you agree to allow Soda Sand to use any photographs or videos taken of you during the event for promotional and publicity purposes through any medium they choose, without compensation or further consent from you. 

Optional Activities 

You acknowledge that during your trip there may be optional activities available that are not part of the official itinerary. You understand that Soda Sand does not endorse or guarantee the safety, quality, or standards of these independent activities and operators. You take full responsibility for participating in these optional activities and release Soda Sand of any liability related to the trip and these activities. You understand that by choosing to participate in these activities, you assume all risks involved and waive the right to hold Soda Sand accountable for any incidents or harm resulting from my participation.

Authority on Tour 

You agree to follow the instructions and decisions of the Soda Sand surf guide or representative at all times, as they are essential for the safety and well-being of the tour. You will abide by all laws, customs, and regulations of the countries visited during the tour and inform Soda Sand of any medical conditions that may affect others.

In the event that your behavior is deemed dangerous, disruptive, or illegal by the tour leader, You understand that Soda Sand reserves the right to terminate my travel arrangements without any liability or refund.

You acknowledge that the standard of transportation, accommodation, safety, hygiene, medical facilities, telecommunications, and infrastructure in some of the visited countries may not be the same as what you may be used to at home. You have read and fully understand the Soda Sand Trip Details and have disclosed any preexisting medical conditions to Soda Sand representatives. You accept these risks and responsibilities and release Soda Sand of any liability related to the tour.
